The Service

ChartSwipe offers tools for discovering and interacting with market charts and related content in a swipe-based experience. Features may include personalized feeds, saved lists, insights, community statistics, and optional subscription tiers. We may modify, suspend, or discontinue any part of the Service with reasonable notice where practicable.

Not financial advice

ChartSwipe is for informational and educational purposes only. Nothing in the Service constitutes investment, tax, or legal advice, or an offer to buy or sell any security or other instrument. Market data and charts may be delayed or incomplete. You are solely responsible for your investment decisions and for complying with laws and regulations that apply to you. Past or community activity does not indicate future results.

Accounts and eligibility

You must provide accurate account information and keep your credentials confidential. You are responsible for activity under your account. You must be old enough to enter a binding contract where you live and not barred from using the Service under applicable law. We may refuse registration or close accounts that violate these Terms.

Subscriptions and purchases

• Paid features may be offered as subscriptions or one-time purchases. When you buy through the Apple App Store or Google Play, the platform's payment terms apply, including how charges, renewals, and refunds are handled. You may manage or cancel subscriptions in your store account settings.
• Prices, features, and tier names are described in the app and may change; material changes will be communicated as required by the stores or by law.
• Access to paid features is linked to your account and entitlements we record after successful purchase; if entitlements fail to sync, contact support@chartswipe.app.

Acceptable use

You agree not to misuse the Service. For example, you must not: scrape or overload our systems; attempt to bypass security, rate limits, or subscription gates; interfere with other users; upload malware; use the Service for unlawful activity; or reverse engineer the app or our APIs except where applicable law permits. We may suspend or terminate access for conduct that risks the Service or other users.

Intellectual property

The Service, including branding, software, and layout, is owned by ChartSwipe or its licensors and is protected by intellectual property laws. Third-party chart data and marks remain the property of their respective owners. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial use in accordance with these Terms.

Our Privacy Policy explains how we collect and use personal information and is incorporated into these Terms by reference.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHARTSWIPE AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR FIFTY U.S. DOLLARS (US $50), IF APPLICABLE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

Indemnity

You will defend and indemnify ChartSwipe and its affiliates against third-party claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms, except to the extent caused by our willful misconduct.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms or if we must do so for legal or security reasons. Provisions that by their nature should survive (including disclaimers, limitations, and indemnity) will survive termination.

Governing law and disputes

These Terms are governed by the laws of the United States and the State of Delaware, excluding conflict-of-law rules, unless mandatory consumer protections in your country require otherwise. You and we agree that courts in Delaware have exclusive jurisdiction for disputes arising from these Terms, subject to mandatory arbitration or venue rules that cannot be waived by agreement.

If you are a consumer in the European Union or United Kingdom, you may have mandatory rights under local law that cannot be overridden by this clause; nothing here limits those rights.

Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page and update the "Last updated" date. Continued use after changes become effective constitutes acceptance of the revised Terms, except where stricter consent is required by law.
